California Privacy Notice

Last modified: October 13, 2026

This notice supplements the Privacy Policy for California residents using Konstantly, operated by KONSTANTLY, LLC. Rights under the California Consumer Privacy Act, as amended ("CCPA"), apply where the law covers the relevant business and processing. This notice does not treat customer-controlled learner records as information we may use independently for unrelated purposes.

Information, sources, purposes and recipients

Depending on your interaction with us, we collect identifiers and contact information; account credentials and settings; commercial and billing records; internet, device and usage activity; approximate location derived from IP or account information; professional or organization information; training and assessment records; and content you provide, including audio and visual material. Account login credentials and some customer-submitted information may qualify as sensitive personal information. We use credentials for authentication and security and customer-submitted information to deliver the requested service, subject to applicable restrictions.

The Privacy Policy describes the sources, purposes, provider categories and retention criteria for these categories. Sources include you, your organization, permitted users, your device and connected services. Business-purpose disclosures include service providers, your organization and authorized recipients, professional advisers, legally required recipients and parties to a business transaction, as explained there. We do not maintain a separate advertising profile from private learner records or sell private workspace content for others' advertising.

Website tracking choices

Website analytics, advertising referral and support tools, including Google Analytics, Capterra and the optional Intercom widget, receive device identifiers and usage information when enabled. Whether a particular disclosure constitutes a sale or sharing under California law depends on the provider arrangement and use. Cookie preferences and Global Privacy Control determine whether these tools load. Our Privacy Policy explains these controls and their limits, including the separate campaign-attribution cookie they do not currently prevent or clear. You can also contact [email protected] to make an opt-out request. We do not knowingly sell or share personal information of individuals under 16.

Requests and rights

Where the CCPA applies, you may request to know or access the categories and specific pieces of personal information collected about you, including relevant sources, purposes and recipients; correct inaccurate information; request deletion subject to exceptions; opt out of sale or sharing; and limit uses of sensitive personal information where that right applies. You have the right not to be unlawfully discriminated against for exercising these rights.

Send requests to [email protected]. Identify the relevant account and request. We may verify your identity in a manner proportionate to the request and may request evidence that an authorized agent can act for you. Opt-out requests do not require creating an account. We respond within applicable legal deadlines and explain applicable exceptions or any permitted extension. For learner information controlled by an organization, direct your request to its administrator; we assist as required.

For California direct-marketing disclosure requests and other privacy questions, use the same contact. Material policy changes are handled as described in the Privacy Policy. Nothing in this notice waives a statutory right.
